Welcome to Jars of Love. “We”, “us”, and “our” refer to Jars of Love (Pty) Ltd., and “you”, “your” refers to a user or customer of our Services. These Terms of Service (“Terms”) govern your use of our website, online store, content, products, and services (collectively, the “Services”).

By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use our Services.

1. ACCOUNT & ELIGIBILITY
   You must be of legal age (18+ or local majority) to place an order. You are responsible for providing accurate, complete, and up-to-date account, billing, and shipping information. You’re responsible for safeguarding your account credentials and all activity under your account.

2. PRODUCTS & DESCRIPTIONS
   We strive for accuracy in our product images, descriptions, and pricing. However, devices and display settings may cause colors or appearance to vary. We reserve the right to discontinue or modify products at any time without notice. All product offers are subject to availability and acceptance by us.

3. ORDERS
   By placing an order, you offer to purchase a product subject to these Terms. We reserve the right to accept or decline any order. Once payment is processed and the order confirmed, you will receive an order confirmation. Cancellation requests may not always be accommodated after confirmation.

4. PRICING & PAYMENT
   Prices listed are in ZAR unless otherwise stated and exclude shipping, handling, import duties, or taxes. You authorize us to charge your payment method for the order total. You warrant you are authorized to use the payment method provided.

5. SHIPPING & DELIVERY
   We endeavor to ship promptly. Delivery times are estimates only and not guaranteed. Once goods are transferred to the carrier, risk and title pass to you. Ensure your shipping address is correct — we are not liable for delivery failures or mis delivery due to incorrect address information.

6. RETURNS & REFUNDS
   All purchases are subject to our Return & Refund Policy, which is incorporated by reference. Due to hygiene considerations, certain items (such as menstrual discs, personal care items, opened consumables) are non-returnable. If a product is defective or the wrong item was sent, contact us within 48 hours with photographic evidence to request a replacement or refund.

7. INTELLECTUAL PROPERTY
   All content, branding, images, logos, and software on the Services are owned by Jars of Love or its licensors, and protected by applicable laws. You may use the Services for your personal use only. Unauthorized use, reproduction, or distribution is prohibited.

8. THIRD-PARTY TOOLS & LINKS
   Our site may provide access to third-party tools or links. We do not control, endorse, or assume responsibility for their content, functionality, or policies. Use them at your own risk.

9. RELATIONSHIP WITH SHOPIFY
   Our Services are powered by Shopify, but all sales and transactions are between you and Jars of Love (Pty) Ltd. Shopify is not liable for product quality, shipping, or customer service.

10. PRIVACY
    We collect and use personal information in accordance with our Privacy Policy. You consent to such collection, transfer, and use, including potential international transfers.

11. FEEDBACK
    If you submit feedback, ideas, or suggestions, you grant Jars of Love a perpetual, worldwide, royalty-free license to use such content in any medium, for any purpose.

12. ERRORS & OMISSIONS
    We may correct errors, inaccuracies, omissions, or cancel orders even after you submit them. We reserve the right to revise pricing or availability.

13. PROHIBITED USE
    You may not use our Services for unlawful, harmful, fraudulent, or abusive purposes. You may not misuse our site (e.g., by transmitting viruses, scraping data, impersonation, etc.).

14. TERMINATION
    We may suspend or terminate access to the Services for violation of these Terms or any unlawful conduct. You remain liable for all obligations incurred prior to termination.

15. DISCLAIMER OF WARRANTIES
    To the extent permitted by law, our Services and products are provided “as is” without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free operation.

16. LIMITATION OF LIABILITY
    Except where prohibited by law, in no event will Jars of Love be liable for indirect, incidental, consequential, or punitive damages arising from or related to the Services or products.

17. INDEMNIFICATION
    You agree to indemnify and hold harmless Jars of Love, Shopify, and their affiliates from all claims, damages, or costs (including legal fees) arising from your breach of these Terms or your misuse of the Services.

18. SEVERABILITY
    If any provision in these Terms is found invalid or unenforceable, it will be limited or removed, and the remainder will remain in effect.

19. WAIVER
    Failure to enforce any right or provision does not waive that right or provision later.

20. ASSIGNMENT
    You may not assign your rights or obligations under these Terms without our written consent. Jars of Love may assign or transfer these Terms freely.

21. GOVERNING LAW & JURISDICTION
    These Terms are governed by the laws of South Africa. Any disputes will be subject to the courts of Gauteng.

22. CHANGES TO TERMS
    We may update these Terms at any time. Material changes will be notified (e.g. via banner or email). Continued use after changes constitute acceptance.
